Silly question about cone filter popping off 94 LX

The person I bought the car from kept the stock intake, but added a K&N cone filter and it constantly pops off.

I really didn't think much of it before, but after working on the car yesterday, when I was backing out of the driveway, I heard a loud pop that I've never heard before. The filter popped off yet again! I put it back on so it was nice and snug, but I made sure I didn't over tighten it. It still keeps coming loose though even if it's a two minute trip to the gas station

Also, the fact that the filter is resting right on the battery is a little unnerving.

This may seem like a very dumb question, but any suggestions?

Just touching the battery isn't a concern as long as it doesn't get near the terminal. You may have to fab something up to restrain the movement a little, but be careful you don't create an issue that causes a rattling sound down the road. As far as the popping off, if the tube end is smooth, then there isn't anything that would keep the filter from popping off from natural motion over time, regardless of tension of the worm clamp. What is needed is a lip or rib around most of the circumference of the black plastic hose. You could try forming one by applying a controlled heat and deforming the edge out and after it cools / rehardens, that may prove enough of a ledge to prevent the filter from popping off. If not in the mood, then just pop a few screws thru both the filter rubber boot end and the tube wall, and maybe seal it up with a little RTV or similar sealant. The worm gear clamp alone will continue to pop off until something is changed though.

Just my 2 cents.
