Check engine light

My engine light will not come on when turning on ignition switch. It has caused my smog test to fail (P0401).

2023 Honda Accord Hybrid with 3,000 miles now showing emission system problem and says my speed may be reduced, see dealer. Really an almost $40k car with 3,000 miles.
Anyone else seeing this, i would love to give it back!
