Trying to replace my clutch today and came along this issue the old throw out bearing is worn out. But the fork moves freely. Is there a part missing ?

Not sure what you mean the fork moves freely. It's supposed to move freely, but kinda held by the spring inside the clutch slave cylinder. Once you remove the slave cylinder, the fork almost flops around loose.

The fork looks okay, looks like a little springgy thing behind the fork is there.

T-O fork sits on a ball-&-socket. The spring #8 holds it onto the ball #7 so it doesn't fall out during assembly.

So that nut #7 is not needed then ? cause the throwout bearing as u can see is rubbing.

#7 is actually a ball not a nut, even though it looks like one :-). #8 fit inside #6 and snap into #7.

I never replaced my clutch on my accord, so I don't know. Make sure you use the proper grease for the shift fork and splines on the transmission. It is high temperature lithium or high temperature urea grease. Don't use regular grease, it will dry out over time.

The pivot ball #7 IS NEEDED.

The spring #8 holds the fork onto that ball so it doesn't fall off during assembly.

Okay thats where i was confused like hell. Cause when u remove the slave cylinder that fork moves in every direction and when we removed the transmission. The old TOB was worn out on the sides.

Now the trans is back up and all. Some Trans oil leaked so my question is can i use Syncromesh or should i use 10W-30
