Well today I got hit by a car that ran a stop sign. I wasn't speeding. I was going stright and all of sudden my mom starts screaming and before I can do anything BAMB, the old guy hit me from the front driver side. Had witness said that the old guy ran the stop sign and told the same thing to the cops. Now, the car was Honda LX 2006, got it in December, dont remember the date but I know it was in December. So the car is not even 1 year old. First question is that would my insurance go up even if it wasn't fault? I have State Farm auto insurance in NJ. Second, would they just "fix" the car or I might get new car since it was kinda very new. And third, should I just go to auto shop that my insurance recommended me to go or go to somewhere else, like the dealership where I got the car?

Personally, I would fight StateFarm to replace the car since it's so new...
I'd hate to buy a car, have it hit and the entire life of the car be so crappy cuz of an accident...

1) I think they'll fix the car. Totaled means that the damage is in excess of 1/3 of the value.
2) It's easier to have the insurance's shop do the work b/c there is no adjuster involved and at least Geico takes care of you well (from my experience). If you have a shop that you trust and would rather have them do the work, by all means, do it.

I drove it home after the accident so it might not be totaled??? But evertime I go over tiny bump or something the car is either gridding the road or my left wheel is hitting the fender cover. I'm just pissed that its not even 1 year old and because of someone I have to drive the car fixed. I would like to get the same car new, not fixed.
What does HIS insurance say? I got hit (few years ago) & the damage was really minor. It was completely drivable, only cosmetic. Still, the other driver's insurance gave me a rental to drive while waiting for parts.
When i was hit, the insurance covered most of the rental ..... true it was a POS Hyundai, but it only cost about $0.15 a day and I got to beat the crap out of it. I don't think that POS got out of 2nd gear more than a mile or 2 when I had it ...... serves them right for telling me that I could have a Cobolt and it being rented when I got there!
He's obviously at fault, you have witnesses to that fact. Since the car is driveable just use it, get 3 different repair estimates. Make CERTAIN that before you settle it completely that you have no medical bills and no lingering pain. Also, your insurance shouldn't go up as long as you don't make them pay anything.
