I know, that device is very different. But both substances can be smoked out of both devices.

Exactly, if he would've listed it as a tobacco pipe and cleaned it, he would have been in the clear, but he had to mention weed and then it became paraphernalia.

No, I could go to the tobacco shop right now and buy a "tobacco water pipe" and it would be perfectly legal.

no, there are plenty of places that sell them new, and as long as there isnt weed ashes in them your fine.
