An update:
Thinking I had nothing to lose, I had sent a polite certified letter to the executive VP at Honda in Torrence, CA. It took 3 weeks but my case manager did call me back last week on Tuesday morning. He said management was re-investigating my tranny failure. He reviewed our prior discussions (none of them were impolite or harsh) and then told me he'd call back by Monday. Well, I had already gone to CarMax and gotten an appraisal over the weekend so I asked him if he could get back by Friday. So, he asked why. I told him that I only had till Sunday to turn the car in to CarMax. He asked if I had gotten it fixed and I said No I was trading it as is. So he said that's good. That should give him enough to get the final decision expediated.

He promised a call back by Friday. I got a call back in less that 10 minutes. He apologized for my troubles on behalf of Honda and then told me that Honda has decided to cover 100%. I knew that would mean only 12 months / 12 K warranty. So, I offered to pay $250 to "share" the cost of the replacement and get the 3 yr/36K miles warranty. He had to ask his upper management again and called back in another 5 minutes and said that was a fair offer and Honda agrees to provide me with 3 yr / 36 K warranty due to my sharing the cost and paying $250 deductible.

I got the tranny replaced Monday. Have been driving it for this week and barring a couple of small issues all is well. The only small issue I have is a whine at cold tranny when you put it in D and lift your foot off the brakes and let it coast. In 5 - 10 minutes once the tranny is warm, the whine is gone. I also have a slight pull to the left. They also forgot to give me back my wheel lock. So, I will be paying 'em a visit today or early next week but apart from that this ended well.

Thanks for the update. It always seems like honest negotiations work better than anger.

UPDATE.... Following dvpatel's lead I too wrote Honda after being denied for another warranty trans. They had the dealership call me today to say that Honda would participate in the repair so my cost went from $3,200.00 to 1385.00. I am glad they made the offer but I still can not justify spending that much on a suspect part. Heck, I can install 3 used ones for that price. It does go a long way towards getting me to consider another Honda in the future though.

Well. I did look into getting a used tranny. None on 'em were below 800 and on top of that, I'd have to pony up for installation. Also remember that now that you would be "sharing" the cost, you would automatically get a 3 year 36K warranty so $1385 though is a lot, seems to be fair. The next best quote with a 3/36K warranty I had was the tranny alone for $2,800 by Jasper Engines.

That is my sticking point. I can install it myself. I have seen some private sale trans for 3 to 4 hundred and junk yards with small warranty for 6 to 8 hundred. So I'm thinking even if I have to do it again in a couple of years I'm still cheaper doing it myself. My time being free and all. Because my honda one went out at 39K I am worried that I would basically be paying for that 36K warranty for nothing. Thank you for your advise on writing them. I appreciate your sharing your info!

Cool

Just went thru a few friends that have the 01-05 Civic auto..
And had them drop a couple off to look at.. in short the frictions and steels were burnt up in all of them ,,,,did a search on them and seems like the frictions and steels are not up to the job..
Been replacing with the upgrade kit that has the Alto frictions and better steels ...
Cost for kit $235 cost to rebuild $500,, cost to rr $300
