beanz, as Falkore said, you have to be aware of CARB restrictions on what mods you can do.

The CAI I purchased works great for me, but won't pass inspections for you.
As long as the item says it's an application for your year of Accord, you should be fine really. Worst case, they should be able to take it back if it isn't an accurate description.

Beanz, the other way is not really legit, but it only takes like 20 minutes to swap an SRI with the stock filter box, so you could actually get a cheepie and swap the filter box when you get inspected ..... or it might be worth the extra money to save you the time, minor hassle and breaking the law. Your call!
