Advice on EBay deal gone bad

Default Advice on EBay deal gone bad

I purchased a used throttle body(drive by wire) for my Volvo off ebay on 3/4/12. The guy said it was tested and worked great and he has 100% feedback with many transactions.

I paid over $200 getting it installed(had to have car towed and have it programmed) then Volvo told me the unit was bad and there was nothing they could do. I messaged the seller telling him this and provided him with the paper work from volvo saying it was bad. He takes forever to respond throughout the whole thing, says it was off his personal vehicle and it worked fine when he took it off. I ended up filing a complaint with ebay, he said he would then exchange it for another unit if I ended the complaint. We agreed even though it is fishy he would have another unit if this came on his personal vehicle like he said it did.

I paid to send the unit back to him(more money I have sunk into this). He received the unit on 4/20/12. I didn't hear from him and I messaged him on 4/22 and he said he was out of town and would be back in town Wednesday and would get back to me. He never did and its now 4/29 and I haven't heard back from him even after sending another message to him.

I looked at his other auctions and they are all for used car parts and they all say tested and work good. I'm guessing this guy just goes to the junkyard and pulls parts then sells them on ebay for more. Should I file another complaint with ebay or paypal? Threaten to do so and leave feedback to light a fire under his butt? Either he is trying to scam me now or he is searching the local junkyards for another unit and can't find one.

You have to refile with ebay and the wait 10 days then escalate it.
You did send it back with a tracking number, right?

You will get your money back. At this point I would not accept a replacement part from him. You need to file as "Item received not as described"

I buy and sell a lot on ebay, you will have no problem getting your money back. Just don't allow him to send you a replacement item cause once you get to far from the purchase date, no matter how much back and forth you have had with the seller, ebay will no longer protect you.

Yes I sent it priority with delivery confirmation. I sent him an email telling him directly what I wanted done and when I wanted it done or I would file again, if he does not answer within 24hrs I will again.

He had said that his computer was broken earlier in the ordeal and thats what took so long, but that was weeks ago, and some of his email responses have said "sent from my android device" so he obviously gets his emails to his phone.

if he can stretch the deal to either 60 or 90 days after the transaction ebay will not help you with it anymore.
It sounds to me that he is trying to do that.
Is your Volvo is not running?

My thoughts exactly.

I put the old unit back in, but I'm not sure how much longer it can hold out, trying to drive the car as little as possible.

Well after that email I got a tracking number, funny how that works huh?
