If you read the response that bill heard issued he's within his legal rights... I think it's completly screwed up to do but I don't think it's going to hurt them and I doubt they'd loose a lawsuit

 

There was no price on the truck and they had the wrong price on the truck. In the end the dealer will loose more than $10K

 

Due to the fact that Mr. Kieselhorst wrote a delay-deposit check, the truck was property of Bill Heard Chevrolet until July 23rd when the final papers would be transferred. Heard contacted the customer and requested the vehicle be returned and offered $500 to the prospective buyer. If Bill Heard had not repossessed the truck, there would probably have been a criminal case against Mr. Kieselhorst for vehicle theft. Perceived as it may, Car Dealers are not evil people, only out to make a living for themselves and their families. The business is no different than walmart or any other retail store... decisions have to be made to keep the lights on, sometimes in the customers favor, sometimes not.


Is Mr. Kieselhorst's situation unfortunate? By all means, it would suck to be in that position... and had he actually paid for the vehicle in cash, there wouldn't be a problem


As for legal contracts, under every-day circumstances the buyer doesnt have any rights to terminate the contract(arkansas, louisiana, texas at least), basically only if he was made drunken or had a gun at his head. People make car-sales out to be a lot bigger of a mountain than they should want to climb, usually salesmen just roll with the punches the customers throw. Example: go to edmunds.com, find the invoice price for your vehicle of interest, go to a car-lot and offer the dealer 300-400 dollars over invoice, you more often than not have a deal right there. Just remember a for-profit organization absolutely must make their money or the only place you'll be buying a car is straight from the factory... and if then, see just how much negotiating the manufacturer will do with you

 

P.S. --- And if anything, all this publicism from the case is only going to increase sales for Bill Heard rampantly. free advertising... what a concept

 

seriously doubt that they are going to get more sales, most people will stay far far away from them
